Terms of Service

These Terms of Service ("Terms") govern your access to and use of Xstaywiseat https://xstaywise.com (the "Service"). By creating an account, purchasing a plan, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Xstaywise provides tools for short-term rental hosts, including:

  • STR profit calculator with market packs and channel fee models
  • AI listing studio (titles, descriptions, images, short video jobs)
  • Multimodal listing agent and Asset Hub library
  • Specialty tools (pet-friendly, glamping, seasonal pricing, compliance checklist)

Features and quotas may change as we improve the product. Some capabilities require a paid plan and working third-party providers (AI generation, payments).

2. Accounts

You are responsible for your credentials and for activity under your account. Provide an accurate email address for billing and security notices. You must be able to form a binding contract in your jurisdiction to use paid features.

3. Subscriptions & billing

  • Paid plans and one-time credit packs are billed through our payment processor (Creem)
  • Subscriptions renew until you cancel in the customer portal linked from payment receipts
  • Plan entitlements and quotas update after payment confirmation
  • Fees are generally non-refundable except where required by law or the processor's policies

4. Acceptable use

Use the Service for lawful STR operations and content production. Do not abuse quotas, attempt to bypass billing, scrape or attack the Service, or generate unlawful, infringing, or misleading content.

5. Estimates & AI outputs

Financial estimates, market packs, and AI drafts are illustrative references only. They are not investment, legal, tax, or compliance advice, and are not live market comps. You remain responsible for listing accuracy, platform policies, and local STR regulations before publishing.

6. Intellectual property

We own the Service software and branding. You retain rights to content you submit; you grant us a license to process it to provide the Service. AI outputs are provided as-is for your commercial use at your own risk.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of liability

To the fullest extent permitted by law, Xstaywise is not liable for indirect, incidental, special, consequential, or lost-profit damages, or for decisions you make based on estimates or AI outputs. Our aggregate liability is limited to fees you paid us in the three months before the claim.

9. Termination

We may suspend or terminate accounts for Terms violations or abuse. You may stop using the Service and cancel paid plans via the payment customer portal.
